Terms and Conditions

1. Scope

These terms apply to all contracts for web design services between Thundersite, Owner: Ali Perviz (Kastanienallee 4, 51399 Burscheid), and the client. Offers are addressed to businesses within the meaning of § 14 German Civil Code (BGB).

2. Services

The scope of services results from the respective offer (e.g. Website Refresh or Website Relaunch). Statements about implementation time, such as "ready in 3 days", refer to business days from the point at which all necessary content and access credentials have been provided.

3. Prices and Payment

The fixed prices stated in the offer apply. Under § 19 (1) German VAT Act (UStG) no VAT is shown (small business rule); all prices are final prices. Payments are due without deduction within 14 days of invoicing. Additional services are agreed upon in advance.

4. Client Cooperation

The client provides texts, images, logos, and access to the domain, hosting, and any existing CMS in a timely manner and warrants that it holds the necessary usage rights.

5. Revisions and Acceptance

The fixed price includes the revision rounds stated in the offer. Acceptance is deemed given if the client does not report material defects in writing within 7 days of delivery.

6. Usage Rights

Upon payment in full, the client receives the simple, temporally and territorially unrestricted usage rights to the design results created. Third-party rights (e.g. fonts, stock images) are governed by their respective licenses.

7. Liability

Liability for intent and gross negligence is unlimited. In the case of ordinary negligence, Thundersite is liable only for the breach of material contractual obligations and limited to the foreseeable, typical damage. No liability is assumed for the availability and security of third-party hosting or other third-party services.

8. Final Provisions

German law applies. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
